The legal battle over whether a Senate with 18 senators is properly constituted is far from settled and could be heading to the Court of Appeal by today, or at the latest, early next week.
This was disclosed by Queen’s Counsel Garth Patterson, the man representing former Attorney General Adriel Brathwaite, whose constitutional motion was dismissed by the High Court on Monday.
He said they believed the judge erred in her ruling and they were prepared to take the matter all the way up to the Caribbean Court of Justice if necessary.
“The appeal documents are in the draft stage and we should be filing tomorrow (today) or Monday. We could have done it sooner, but I have only just come back to the island yesterday [Wednesday] and we are now ready to proceed. We have to first go through the Court of Appeal and according to how things go there, we will go all the way up to the Caribbean Court of Justice,” Patterson said. (CLM)
