Appeal Court hears curfew breaker’s case

Chief Magistrate Ian Weekes “got it wrong” when he sentenced Jamaican Dean George Scott to six months in jail for breaking quarantine to get a sweet drink.

This was the submission of Queen’s Counsel Andrew Pilgrim, who was arguing in the Court of Appeal yesterday.

However, Senior Crown Counsel Oliver Thomas argued the Chief Magistrate has always been consistent in his approach to sentencing quarantine breakers and it just happened that all the others were in positions to pay fines.

Chief Justice Sir Patterson Cheltenham and Justices of Appeal Rajendra Narine and Margaret Reifer will give their decision today.

Scott, 49, a mason, who was a guest at Crystal Beach Hotel, had pleaded guilty before Chief Magistrate  Weekes to contravening Paragraph (14) of the Emergency Management (Covid-19) Curfew No. 4 Directive, 2020, in that being a person in quarantine at the St Lucy District Hospital, he left the facility without a reasonable explanation on December 7 last year.
