Attorneys spent the entire day’s sitting dealing with case management issues when the civil suit brought by former Attorney General Adriel Brathwaite challenging the validity of Parliament continued yesterday.
By the end of the day’s proceedings, Queen’s Counsel Garth Patterson, who is representing Brathwaite, and fellow QC Leslie Haynes, who is leading Government’s team of lawyers, had agreed that the major issue to be thrashed out was whether Parliament was properly constituted, under the provisions of the Constitution with an 18-member Senate.
The motion challenging the constitutionality of Parliament is alleging that the Senate, with only 18 senators, was not properly constituted and, therefore, by extension, neither was Parliament.
The application for judicial review claims that any business conducted by Parliament on or after February 4 this year, “including any law purportedly enacted by it, is invalid, null and void”. (HLE)
