IN TWO WEEKS, controversial Cuban national Raul Garcia will face a High Court judge who will determine if his immigration detention will continue or if he should be set free.
Yesterday, Justice Margaret Reifer ruled that Garcia’s lawyers had established a “prima facie” case of unlawful detention and ordered that a writ of habeas corpus be issued directing the Minister Responsible for Immigration and the Chief Immigration Officer “to have the body of the Claimant Raul Garcia” brought before a judge of the Supreme Court on October 24 at 9:30 a.m., in order that the Court may determine whether his detention is lawful or unlawful and whether he should be released.
The order was issued following a two-hour presentation by a team of attorneys at law, including David Comissiong, Paula Jemmott and Ajamu Boardi who had filed the application.
Lead counsel Leslie Haynes, QC, is out of the island.
