BBS must pay up

ADMIRABLE, BUT NO DIFFERENT.

This was the view of the Copyright Tribunal as it ordered Barbados Broadcasting Services Ltd. (BBS) radio station and its owner Anthony Bryan to pay royalties, dating back to 2006, at the same rate as all the other stations on the island, to the Copyright Society of Composers, Authors and Publishers, COSCAP Barbados.

However, as a result of “administrative delays” which plagued the matter, tribunal chairman Emmerson Graham has urged COSCAP to treat BBS radio station as a new and emerging station from 2006 to December 2014 before applying the regular tariff from 2015 and on.

In December 2001, COSCAP took BBS to court for infringing the Copyright Act. In 2007, the High Court imposed an injunction on BBS preventing the station from infringing COSCAP’s copyright by engaging in, or otherwise permitting the broadcasting of musical works within COSCAP’s repertoire.
