The prestigious Sandy Lane Hotel has lost a court battle for the third time in relation to the wrongful dismissal of three former employees.
The Caribbean Court of Justice (CCJ) yesterday held that the three employees, Juliana Cato, Wayne Johnson and Charmaine Poyer, were wrongfully dismissed by the St James hotel and entitled to the damages that they claimed. The court also granted the former employees their legal costs.
The Trinidad-based court was the third court to find in favour of the employees following similar rulings by a Magistrate Court and the Court of Appeal.
Sandy Lane Hotel had employed the employees for periods between six and 11 years when they were each dismissed in January 2012 with one week’s payment in lieu of notice. The reason for each dismissal was alleged poor performance towards a particular hotel guest. The employees brought wrongful dismissal actions, claiming damages under the Severance Payments Act. (MB)
