THE NEW Commissioner of National Insurance rebuked an NIS tribunal as he awarded a Government clerk all of his injury benefits in an eight-year-old case.
Citing the “unfortunate history” of the case, Commissioner Peter Williams, a retired jurist in his first appeal adjudication involving the National Insurance Scheme (NIS), made “an adverse comment” on the four years it took the tribunal to render its written decision.
He said the delay constituted a breach of the appellant’s constitutional right to a fair hearing and a decision within a reasonable time.
The matter involved Dennis Darwin Boyce, a clerical officer in the Government Printing Department. On April 30, 2007, Boyce submitted a claim to the NIS for employment injury benefit after he suffered a back injury at work when he was pushed onto a door by another employee. (MB)
