A High Court Judge has ruled that it would be “unjust” for two construction companies which were involved in the terminated flyovers project to wait until 3S Barbados SRL settles its financial dispute with Government in order to get paid.

Justice Pamela Beckles made this ruling earlier this year when she dismissed an application filed by 3S Barbados SRL to have two claims against them brought by C.O. Williams Construction Ltd and Rayside Construction Ltd sent to arbitration instead of being dealt with by the court. The US based company which was contracted to build the multi-million dollar fly-overs in 2006, was fired in 2008 by the Democratic Labour Party, before they could get the fly-overs built.

C.O. Williams and Rayside, who were involved in widening the highway in preparation for the flyovers, are claiming $22 million from the beleaguered company for the work they did.

However, 3S contended that it was the intention and understanding of the parties that the monies to be paid to the two companies would derive from monies 3S received from Government. (MB)
