IT’S OVER TO THE Director of Public Prosecutions to decide if and what charges waste hauler Anderson Cherry will face for the illegal dump site in the quarry at Lower Estate, St Michael.

And Chief Town Planner Mark Cummins has stressed neither he nor his office was unfairly targeting the owner of Jose & Jose and the business in the quarry, Project Recycle Ltd.

Cummins told the Saturday Sun yesterday, that the matter against Cherry, who said he was operating a recycling plant at the quarry in Lears/Lower Estate, St Michael, was illegal since the operation did not have the necessary Town and Country Planning permission.

He said that while he did not have the specifics as to what materials were being ferried to the quarry located just off an upscale neighbourhood in St Michael, the dumping in the quarry was “a material change in the use of the quarry”.
