HEAVY-HANDED! That is how Queen’s Counsel Dale Marshall has described a move by the Department of Commerce and Consumer Affairs to stop popular membership club ShopSmart from selling hams at a time when last-minute shoppers were trying to get their hands on the Christmas staple. And he has instructed his client to continue selling.
Inspectors from the department, under the watchful eye of members of the Barbados Police Force, descended on the Holders Hill location yesterday morning, accusing the business of not complying with the section of the Weights and Measures Act which states that meat has to be priced with its weight and measurements displayed.
Section 17(1) of the act states: “Subject to the regulations, no person shall sell any prepacked goods by weight or measurement unless the net weight or the capacity measurement of those goods is marked on the container in the prescribed manner.”
The ministry was of the view that by selling all their hams at one price, ShopSmart was operating in violation of the law.
