A?high court?judge will decide early next week if Columbus Communications Inc. can continue using the business name “Flow”.
Justice Jacqueline Cornelius heard arguments yesterday from attorneys at law in the case in which Freedom Telecommunications Inc. is asking for an interlocutory injunction to restrain TeleBarbados and any affiliate or subsidiary company, including Columbus Communications and Karib Cable, from using the trade name.
Attorney at law David Bryan appeared for Freedom Communications Inc., while Queen’s Counsel Dale Marshall, in association with Andrew Thornhill, appeared for Columbus Communications.
The matter was heard in chambers.
According to court documents, Freedom Communications Inc. argued that it had registered the disputed name at the Corporate Affairs and Intellectual Property Office (CAIPO) several years ago before Columbus Communications, which also trades regionally as Flow,?entered the marketplace.
Bryan submitted that as a result, Freedom Communications had ownership rights to the name and therefore was protected, while pointing out that another company could not register the name without consent from the owner.
