No surety, so accused trespasser goes up

He was granted bail, but he had no surety, so Fabien Shawn Austin, 48, ended up at HMP Dodds.

Austin, who has no fixed place of abode, pleaded not guilty to entering Sandra’s Hot Food between February 17 and 18 as a trespasser and stealing 25 cases of empty bottles and two boxes of fish, valued $550, belonging to Keveil Evans.

Magistrate Kristie Cuffy-Sargeant granted him bail on Wednesday, but prosecutor Station Sergeant Cameron Gibbons said his only concern was that the accused had no address, and if granted bail, he may not return.

It was then Austin told the District “A” Magistrates’ Court he lived in Wildey Road, St Michael.

“Where on Wildey Road?” the magistrate asked.

“Clapham,” he responded.

“Where in Clapham?” she pressed.

“Out by a shop,” he said with a big smile on his face.

The magistrate asked Austin if he had anyone to sign his bail. He said his aunt, but he did not know her number.

He was remanded to HMP Dodds

and instructed that if anyone came forward to sign his bail they should contact the court. He returns on March 20.
