Judge tosses PSV operators’ challenge

A High Court Judge has tossed out a claim by some public service vehicle (PSV) operators who challenged the need to get Barbados Revenue Authority (BRA) and National Insurance Scheme (NIS) clearance in order to be granted permits.

Their attorney, who had claimed racism in the challenge, has called the decision “unfortunate”.

The Association of Public Transport Operators (APTO) brought a civil suit against the Ministry of Transport and Works (MTW), challenging the fact that they needed to obtain BRA and NIS clearances in order to get their permits.

APTO claimed that Regulation 48 of the Road Traffic Regulations was unconstitutional and ultra vires and that other operators were exempt. (HLE)
