Buggery section raised at CCJ

Section 9 of the Sexual Offences Act, which speaks to buggery, could well be deemed unconstitutional.

Principal Crown Counsel Krystal Delaney hinted at the development during a virtual hearing of the Caribbean Court of Justice (CCJ) on Tuesday.

She told the seven-member panel based in Trinidad that there were cases of that nature before the courts in Barbados, pending a decision.

“But from speaking to colleagues at the Solicitor General’s Chambers, they have not objected to arguments that Section 9 is unconstitutional,” she said.

Delaney and Senior Crown Counsel Oliver Thomas are appealing a decision upheld by the Court of Appeal, that a man could not rape another man. (RA)
