IN WHAT CAN BE DESCRIBED as a landmark decision, the High Court has ruled that compulsory membership of the Barbados Bar Association is unconstitutional.

But the decision handed down by Justice Pamela Beckles last Friday on a 2015 claim brought by former Bar president Tariq Khan against attorney Vonda Pile, has received mixed reaction from the parties.

Khan, who refused to say if he intended to appeal the decision, maintained it was a matter the association must follow through, while an elated Pile voiced her satisfaction.

In the 19-page judgment, Justice Beckles determined that no law, including the Legal Profession Act (LPA), was more supreme than the Constitution of Barbados, which spoke to freedom of association.
