THE CARIBBEAN COURT OF JUSTICEĀ (CCJ) has ordered the immediate release of a prisoner serving a five-year sentence for the sexual molestation of a six-year-old girl.

The regional court on Tuesday fired off instant orders the same day to local authorities at the prisons, courts and Director of Public Prosecutions’ office to free Clarence Sealy, 67, who was convicted in May 2011.

The CCJ cited the Court of Appeal’s failing to take into account the time Sealy was in prison prior to his sentencing in September 2012.Ā from-the-courts-bloc

The turn of events came after Sealy’s lawyers Satcha Kissoon and Philip McWatt had asked the CCJ to rule on the law permitting police to read from their official notebooks, oral statements attributed to accused but not initialled by them. The other ground they argued was that the warning given by trial judges on such reading aloud was not full or fair as the judicial officer should say why the evidence was unreliable. (AC)
