Appeal in constitutional motion adjourned

The Appeal brought against a preliminary point in the constitutional motion by former Attorney General Adriel Brathwaite, who is challenging the validity of Parliament, has been adjourned until January 24 next year.

The matter was heard by Chief Justice Sir Patterson Cheltenham and Justices of Appeal Rajendra Narine and Jefferson Cumberbatch yesterday.

Brathwaite’s constitutional motion has alleged that the Senate, with only 18 senators at the time, was not properly constituted and therefore by extension, neither was Parliament.

The application for judicial review claimed that any business conducted by Parliament on or after February 4 this year, “including any law purportedly enacted by it, is invalid, null and void”. (HLE)
